Personal Information Collection Statement For Hong Kong SAR Residents 

This Personal Information Collection Statement (“PICS”) is made in accordance with the guidelines issued by the Privacy Commissioner for Personal Data. The PICS sets out the purposes for which your Personal Data will be used following collection, what you are agreeing to with respect to our use of your Personal Data and your rights under the Personal Data (Privacy) Ordinance, Cap 486 (“PDPO”). 

Purpose of Collection 

The Personal Data provided to us when you create an account or interact with us may be used for one or more of the following purposes: 

  • to verify your identity and eligibility to register an account with us; 
  • to process the creation of your account and to maintain and manage your account; 
  • to process and complete the payment for any purchases of our products and/or services made by you; 
  • to ship any products that you have purchased to you; 
  • to allow you to participate in sweepstakes, contests, and similar promotions; 
  • to send you technical notices, security alerts, and support and administrative messages;  
  • to respond to your comments and questions and provide customer service; 
  • to communicate with you about products, services, and events offered by us and others that we think will interest you; 
  • to send administrative or transactional information to you such as information regarding the services and changes to our terms, conditions, and policies; 
  • to detect, investigate, and prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and security threats and to protect our rights and property and the rights and property of others; 
  • for our business purposes, such as analytics, data analysis; recordkeeping and audits; fraud monitoring and prevention; risk management; investigations; developing new products and services; enhancing, improving, or modifying our products and services; identifying usage trends; determining the effectiveness of our promotional campaigns; and operating and expanding our business activities; 
  • to train our artificial intelligence or machine learning algorithms or models (or those provided by our service providers) for our business purposes and to improve our services; 
  • to confirm your age and identity; 
  • to provide you with information of benefits available to our customers, including marketing materials related to our products and services; and 
  • to conduct audits of our transactions, including potentially calling you to verify end-to-end transactions. 

Please note that it is mandatory for you to provide certain personal data to use certain of our products and services. In the event that you do not provide such personal data, we may not be able to provide you with our products or services. 

You may also choose to opt out of receiving any direct marketing from us. 

Transfer of Personal Data 

If necessary, for any of the purposes stated above, we may transfer your personal data to third parties, including:  

  • third-party service providers (including but not limited to audit professionals and credit bureaus), merchants (including but not limited to service providers outside Hong Kong, mailing houses, logistics solutions providers, telecommunication companies, call centres, data processing companies and cloud service providers) engaged by us for any of the purposes stated above;  
  • our related companies within the A-Mark Group, including subsidiaries and affiliated companies, whether in Hong Kong or otherwise.  

We will also disclose personal data when required to do so by law and may also disclose such personal data in response to requests from law enforcement agencies or regulatory authorities, or where disclosure is necessary to protect our legal rights, enforce our agreements, or protect the rights, property, or safety of others or ourselves.  For example, we may share information to reduce the risk of fraud or if someone uses or attempts to use our websites for illegal reasons or to commit fraud. 

Access to and/or Correction of Data 

You have the right to request access to and correction of your Personal Data in accordance with the provisions of the PDPO. You can make your request by completing the appropriate forms prescribed by the Office of the Privacy Commissioner for Personal Data and contacting us in accordance with the details set out under “Enquiries” below. When such requests are made, we will check the requestor’s identity to ensure the requestor is legally entitled to make the data access or correction request. We may reject a request if such request does not comply with the relevant provisions of the PDPO. You may also submit a request at the Gold.com Online Consumer Request Form or by sending an e-mail to [email protected]

Retention 

Personal Data provided to us in connection with the creation of an account will be retained by us until it is no longer required for the purposes set out above, unless erasure is prohibited by law or is not in the public interest.
